Claims are not considered Settled Claims under the terms of the Settlement

multiple damages based on PPH. PPH Claims must be pursued outside of the
structure of the Settlement Agreement....However, Class Members who
received Settlement benefits from Fund B may not bring a lawsuit based
upon a claim for PPH-unless they were diagnosed with PPH before having
left-sided heart valve abnormalities (other than those which produce trivial,
clinically insignificant left-sided regurgitation) or Endocardial
Fibrosis...."
